Terms of Use — GBA Play

GBA Play provides emulation tools. It does not provide games or grant rights to copyrighted content. You are responsible for having the legal right to use everything you load.

1. Acceptance

These Terms apply to your use of GBA Play: Retro Emulator and this website. By using the app, you agree to these Terms to the extent permitted by applicable law. If you do not agree, discontinue use. If you cannot enter into an agreement yourself, use must be authorized by a parent or legal guardian where required.

2. License to Use the App

Subject to these Terms and the rules of the store through which you obtain the app, you may install and use GBA Play for your personal, lawful use. This permission does not transfer ownership of the app or of any third-party game content.

Open-source components are governed by their own licenses. These Terms do not restrict rights those licenses grant you.

3. User-Provided Game Files

You must provide your own legally obtained game files. You are responsible for ensuring that you have the legal right to use any ROM, patch, BIOS, save, or other game content you load or use in connection with the app.

GBA Play does not supply commercial ROMs, a proprietary Game Boy Advance BIOS, or a game-download service. It does not verify the legal status of the files you select.

4. ROMs and Copyright

The app does not grant you rights to copyrighted games. The ability to load or emulate a file does not establish permission to copy, download, distribute, modify, or use that content. Ownership of a physical game does not by itself settle what copying or downloading is permitted under the laws that apply to you.

Respect copyright and other intellectual-property rights. GBA Play does not provide instructions or links for obtaining unauthorized game files.

5. Patches

Patching tools support IPS, BPS, and UPS patches. Use them only with game files and patches you are legally entitled to use and, where relevant, modify. A patch's availability does not grant rights to the original game or to third-party content contained in the patch.

Use a compatible base game version and keep an original copy. Patches may be incompatible, contain errors, or affect save compatibility. GBA Play cannot guarantee the behavior of user-supplied patches.

6. Save Files

Current Progress, snapshots, backups, and Timeline are stored locally. They are different forms of saved data and are not interchangeable in every situation. Imported .sav files must be compatible with the selected game.

Save protection reduces some risks but does not guarantee that progress can always be recovered. Keep separate exports of important saves, especially before importing, restoring, modifying a game, clearing storage, or uninstalling. GBA Play currently provides no cloud backup or cross-device sync.

7. Prohibited Use

Do not use the app or website to infringe the rights of others, distribute content unlawfully, introduce malicious files, interfere with the app or third-party services, or commit advertising fraud. Do not misrepresent an affiliation with GBA Play or a game publisher.

Nothing in this section overrides activities protected by applicable law or permissions granted under an applicable open-source license.

8. Advertising

GBA Play uses third-party advertising. Certain optional actions, including changing a control theme and accessing Game Timeline, use rewarded ads in the current app. The app explains the action or access period offered before you choose it.

Ad availability can vary by connection, region, consent, and third-party availability. No promise is made that every theme or feature will always be free, unlocked, or accessible through an ad. Advertising data practices are described in the Privacy Policy.

9. Third-Party Services

Google Play, Google advertising and consent services, external websites, controllers, and user-selected storage services are operated by their respective providers. Their terms and privacy policies may apply. Linking to a service or displaying an advertisement is not an endorsement of its content or a guarantee of its availability.

10. Intellectual Property

Rights in GBA Play's original interface, artwork, and other original materials remain with their respective rights holders. Third-party software remains subject to its own licenses. See the Open-Source Notices for the emulator components identified in the Android project.

Game Boy Advance, Nintendo, and all other third-party names and trademarks belong to their respective owners. They are used only to identify compatibility or explain the app. No affiliation or endorsement is implied.

11. Disclaimer of Warranties

To the extent permitted by law, the app is provided “as is” and “as available,” without promises of uninterrupted operation, compatibility with every device, controller, game, patch, or save, or freedom from errors. Some jurisdictions provide mandatory warranties or consumer guarantees; those rights are not excluded.

12. Limitation of Liability

To the extent permitted by applicable law, the publisher is not responsible for indirect or consequential loss arising from use of the app, including loss of game progress or files. This does not exclude or limit liability where doing so would be unlawful, or remove mandatory consumer rights.

No fixed monetary liability cap is stated in this version of the Terms.

13. Changes

The app and these Terms may change. Updated Terms will be posted with a revised date, and notice or consent will be provided where required. Changes do not remove rights already granted under applicable law.

14. Termination

You may stop using and uninstall the app at any time. Export saves you wish to retain first. Permission to use the app under these Terms may end if you materially breach them, subject to applicable law. Termination does not remove rights in open-source components granted by their own licenses.

15. Governing Law

No specific governing-law jurisdiction is designated in this version. Publisher identity and jurisdiction details are pending verification. The laws and mandatory consumer protections applicable to you remain unaffected.
